Terms & Conditions

Last updated: 25 October 2026

1. About these terms

These terms apply to your use of xiwustudio.com (the "Site") and to any order you place with us. By using the Site or placing an order, you agree to be bound by these terms. If you don't agree, please don't use the Site.

In these terms, "we", "us", "our", and "Xi Wu Studio" refer to Xizhu Wu trading as XIWU STUDIO (ABN 69 821 270 329). "You" means the visitor or customer.

These terms should be read together with our Shipping & Returns Policy (https://xiwustudio.com/shipping-returns), which forms part of your agreement with us. Our Privacy Policy (https://xiwustudio.com/privacy-policy) explains how we handle personal information; accepting these terms does not itself give consent to marketing or optional tracking.

2. Changes to these terms

We may update these terms from time to time. Changes take effect when published, and the "Last updated" date above reflects the latest version. Continuing to use the Site or place orders after a change means you accept the updated terms. We won't apply changes retrospectively to orders we've already accepted.

3. Using the Site

You agree to use the Site lawfully and respectfully. You must not:

  • Hack, circumvent security, or otherwise disrupt the operation of the Site

  • Place an unreasonable burden on our systems — for example, automated scraping that affects performance

  • Use the Site or our content for any commercial purpose other than buying from us, without our written consent

4. Customer accounts

Where we provide customer accounts, you're responsible for the security of your account credentials. Tell us at orders@xiwustudio.com if you suspect unauthorised access to your account.

Any suspension or closure of an account is subject to the grounds, notice and protections in clause 19. Closing an account doesn't affect orders we've already accepted, and your statutory rights remain unaffected.

5. Orders and contract formation

When you complete payment at checkout, you and Xi Wu Studio enter into a contract for sale of the items at the price and on the terms shown. We'll email you an order confirmation as soon as your order is received.

We may cancel an order only where we have reasonable grounds and it is reasonably necessary because:

  • An item turns out to be unavailable (e.g., stock figures were inaccurate at the moment of payment)

  • There's been an obvious pricing or description error (see clause 6)

  • There is evidence of fraud or an unauthorised payment and reasonable verification cannot resolve the issue

  • Delivery to your address is unlawful or cannot reasonably be arranged

We'll explain the reason promptly, give you a reasonable opportunity to resolve an address or verification issue where practicable, and refund all amounts paid for the cancelled order, including shipping, without undue delay and within 14 calendar days of notifying you of the cancellation. We won't substitute products or charge a higher price without your agreement. Cancellation under this clause doesn't affect your rights under the Australian Consumer Law or any other mandatory law.

6. Pricing, currency and errors

All prices on the Site are displayed and charged in Australian Dollars (AUD). Displayed prices include any Australian taxes we are required to charge. Shipping and any other charges we collect are disclosed before you pay. Some banks or payment methods may add their own foreign-currency or cross-border transaction fees, which are outside our control. Destination import charges are explained in our Shipping & Returns Policy.

If there is an obvious and material pricing or description error, we'll contact you promptly to explain it. Any cancellation must meet clause 5 and applicable law. We won't use this clause simply because a price is less profitable than intended, and you do not have to accept a revised price or substitute item.

7. Stock availability

We make our best effort to keep product availability accurate. Occasionally an item may sell out between order placement and processing, in which case we'll contact you, refund the order, or arrange an alternative — your choice.

8. Payment

Payment is processed through Squarespace Payments using the payment methods shown at checkout. Payment data is handled by Squarespace Payments and its payment service providers under their applicable terms and privacy policies. We do not store full payment-card numbers or card security codes ourselves.

9. Delivery, returns and exchanges

Shipping rates, delivery timing, returns, exchanges, and refunds are governed by our Shipping & Returns Policy (https://xiwustudio.com/shipping-returns), which forms part of your agreement with us when you place an order.

Risk and title. Risk in the goods passes to you when they're delivered to the address you provided at checkout. Title (legal ownership) passes when we've received payment in full and the goods have been delivered. If a parcel is lost or damaged in transit before delivery, contact us at orders@xiwustudio.com — we'll work with the carrier to investigate, and your remedies under the Shipping & Returns Policy and the Australian Consumer Law apply.

10. Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the ACL that cannot lawfully be excluded.

In particular:

  • For a major failure (for example, an unsafe product or a significant departure from its description), you can reject the goods and choose a refund or replacement, or keep them and claim compensation for their reduced value, as provided by the ACL. You may also be entitled to compensation for reasonably foreseeable loss or damage.

  • For a minor failure, we can generally remedy the problem by repairing it free of charge within a reasonable time, or choose to replace or refund. If we cannot or do not remedy it within a reasonable time, further rights may arise, including recovering reasonable repair costs or rejecting the goods for a refund or replacement.

Our voluntary seven-calendar-day request and posting deadlines and original-packaging conditions do not limit these rights. Their duration depends on the goods and circumstances, including their nature, price and expected useful life. Our Shipping & Returns Policy explains how to make a claim and how return costs and refunds are handled.

Nothing in these terms takes away rights under other applicable laws that cannot lawfully be excluded, including mandatory protections that may apply to customers outside Australia.

The clauses that follow (in particular Disclaimer, Limitation of Liability, Responsibility for misuse, and Termination) are subject to this clause.

11. Intellectual property and brand assets

All content on the Site — including images, text, designs, look and feel, and trademarks — is owned by us or licensed to us. "Xi Wu Studio" and our associated marks are our trademarks, registered or unregistered.

You may:

  • View, print, and download Site content for personal, non-commercial use

  • Share product images and Site content on personal social media, provided you tag or credit @xiwustudio

You may not:

  • Except for the uses expressly permitted above or allowed by law, copy, modify, redistribute, sell, or commercially exploit Site content without our written consent

  • Use our trademarks in any way that suggests endorsement or affiliation without our written consent

  • Frame, scrape, or systematically harvest Site content

  • Remove copyright, trademark, or other proprietary notices from Site content

12. Third-party links

The Site may link to third-party websites. We don't control those sites and aren't responsible for their content, accuracy, or practices. This does not exclude responsibility for our own conduct or any liability that cannot lawfully be excluded.

13. Disclaimer

The Site is provided on an "as is" basis. To the maximum extent permitted by law, we don't warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. This does not qualify product descriptions, order details or express promises we make about our goods.

Photography and colour variation. We make our best effort to represent each garment accurately. Screens, lighting and fabric batches can affect appearance, but this does not excuse goods that fail to match their description or sample, or otherwise fail a consumer guarantee. We'll assess any reported difference on its merits under the Australian Consumer Law and our Shipping & Returns Policy.

This clause is subject to clause 10 (Australian Consumer Law).

14. Limitation of liability

Our liability is determined by applicable law. These terms do not cap your remedies at the purchase price or exclude compensation you are entitled to recover, including reasonably foreseeable loss or damage under the Australian Consumer Law. We remain responsible for our own negligence, breach of contract and other conduct to the extent provided by law.

15. Responsibility for misuse

You are responsible under applicable law for loss caused by your unlawful use of the Site or infringement of another person's rights. We will take reasonable steps to minimise any loss. You are not responsible for loss to the extent caused by our own conduct, negligence or breach. This clause does not create a separate obligation to indemnify us or pay our legal costs.

16. Events beyond our control

Events outside our reasonable control, such as natural disasters or carrier disruptions, may affect delivery. We will take reasonable steps to minimise their impact and keep you informed. This does not excuse our own failure to take reasonable care.

If such an event affects an order, we'll explain the expected delay and any available alternatives. If we cannot supply within an agreed essential timeframe or a reasonable time, you may cancel the affected items for a full refund of the amounts paid for them and their delivery. We may cancel only if supply cannot reasonably be completed. Any refund under this clause will be processed without undue delay and within 14 calendar days of cancellation; we won't require you to accept an indefinite extension. This clause does not limit the earlier pre-dispatch cancellation rights or delay remedies in our Shipping & Returns Policy.

This clause doesn't override your statutory rights under the Australian Consumer Law.

17. Security of information

No data transmission over the Internet can be guaranteed totally secure. We take reasonable steps to protect your information as explained in our Privacy Policy (https://xiwustudio.com/privacy-policy). This does not remove our security obligations or make you responsible for a failure by us or our service providers for which we are legally accountable.

18. Privacy

Personal information is handled in accordance with our Privacy Policy (https://xiwustudio.com/privacy-policy). Use of the Site does not itself constitute consent to marketing or optional tracking. Privacy enquiries can be sent to info@xiwustudio.com.

19. Termination

We may reasonably restrict your access to the Site where:

  • You materially breach these terms, or

  • We reasonably believe termination is necessary to protect the Site, our customers, or our systems

Where practicable, we'll explain the reason and allow a reasonable opportunity to resolve it. Immediate suspension may be necessary for security, fraud prevention or legal compliance. Termination doesn't affect orders we've already accepted or prevent you from contacting us for support or exercising statutory rights. Sections that by their nature should survive termination (including clauses 10, 11, 13, 14, 15, and 21) survive.

20. General

  • Severability — If a court finds any clause unenforceable, the remaining clauses stay in full force.

  • Your agreement — These terms, our Shipping & Returns Policy, and the product description and order details shown when you purchased govern your order. Nothing excludes a representation, promise or remedy that you may rely on under applicable law. If these terms and the Shipping & Returns Policy differ on a return benefit, the more generous express benefit applies, subject always to mandatory law.

  • Waiver — If we don't enforce a right or remedy under these terms on one occasion, that doesn't mean we've waived it for the future.

  • Transfer of obligations — Neither party may transfer obligations under an accepted order without the other's consent, unless permitted by law. Consent must not be unreasonably withheld where the transfer will not reduce the other party's rights or ability to enforce them. A business sale does not remove your rights in an existing order.

21. Governing law and jurisdiction

These terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. The courts of New South Wales have non-exclusive jurisdiction. This does not prevent you from bringing a claim in another court or tribunal with jurisdiction, or deprive you of mandatory protections under other applicable laws.
